1. Acceptance of Terms
By accessing and using the Lōkahi mobile application ("App"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
2. Description of Service
Lōkahi is a platform that connects users with Hawaiian popup events, food vendors, and cultural gatherings. The App facilitates event discovery, ticket booking, and payment processing.
3. User Accounts
3.1 Account Registration
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information and to update such information as necessary.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Age Requirement
You must be at least 13 years old to use this App. Users under 18 must have parental consent.
4. Payment Processing and Refunds
4.1 Payment Processing
- We use Stripe to process payments for paid event tickets
- Payment card information is collected and stored securely by Stripe (PCI-DSS compliant)
- We do NOT store your full payment card numbers
- You authorize us to charge the total ticket price, including applicable fees
- All prices are displayed in USD unless otherwise specified
4.2 Platform Fees
- We charge a platform fee on paid event tickets (typically 10% of ticket price)
- Stripe payment processing fees apply (typically 2.9% + $0.30 per transaction)
- All fees are disclosed before purchase completion
- Fees are non-refundable, even if a refund is issued
4.3 Host Payouts
- Event hosts must create a Stripe Connect account to receive payouts
- Hosts receive ticket revenue minus platform fees and payment processing fees
- Payouts are processed according to Stripe's payout schedule
- Hosts are responsible for providing accurate banking information
- Hosts may be required to provide tax information (e.g., SSN, EIN) to Stripe for IRS reporting
4.4 Refund Policy
We operate a tiered refund policy based on time until event:
48+ Hours Before Event: Automatic full refund (minus fees)
- Buyers can request refunds directly through the app
- Refunds are processed automatically without host approval
- Platform and payment processing fees are non-refundable
24-48 Hours Before Event: Host discretion
- Buyers can request refunds through the app
- Event host must approve or deny the refund request
- Host approval results in full refund (minus fees)
- Host denial means no refund is issued
Less Than 24 Hours Before Event: No refund eligible
- Refund requests are not accepted
- All sales are final
- Exceptions may be made at our sole discretion for extraordinary circumstances
4.5 Refund Processing
- Approved refunds are processed within 5-10 business days
- Refunds are issued to the original payment method
- Platform fees and payment processing fees are non-refundable
- We reserve the right to deny refunds for suspected fraud or abuse
4.6 Event Cancellation by Host
- If a host cancels an event, all attendees receive automatic full refunds (including fees)
- Hosts are responsible for canceling events with sufficient notice
- Repeated cancellations may result in account suspension
4.7 Payment Disputes
- Payment disputes should be reported to lokahi.helpline@gmail.com
- Chargebacks may result in account suspension pending investigation
- We reserve the right to provide transaction details to card issuers

5. User Conduct
You agree not to:
- Use the App for any illegal purpose
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems to access the App
- Impersonate any person or entity
- Interfere with the proper functioning of the App
6. Event Organizer Responsibilities
If you organize events through the App, you agree to:
- Provide accurate event information
- Deliver the event as described
- Comply with all applicable laws and regulations
- Handle customer service and refunds according to your stated policy
- Maintain appropriate licenses and permits
7. Intellectual Property
The App and its original content, features, and functionality are owned by Lōkahi and are protected by international copyright, trademark, and other intellectual property laws.
8. Content Ownership and License
8.1 User Content
You retain ownership of content you post. By posting content, you grant Lōkahi a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content.
8.2 Content Removal
We reserve the right to remove any content that violates these terms or is otherwise objectionable.
9. Disclaimers
The App is provided "as is" without warranties of any kind. Lōkahi does not guarantee the accuracy, completeness, or reliability of any content or event information.
Lōkahi is not responsible for the conduct of event organizers or attendees, or for the quality of events listed on the platform.
10. Limitation of Liability
To the maximum extent permitted by law, Lōkahi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
11. Indemnification
You agree to indemnify and hold harmless Lōkahi from any claims, damages, or expenses arising from your use of the App or violation of these terms.
12. Changes to Terms
We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the modified terms.
13. Termination
We reserve the right to terminate or suspend your account at any time for violation of these terms or for any other reason.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lōkahi operates.
